TERMS OF USE

The rules of the marketplace.

These Terms govern access to CardQuay and explain the relationship between CardQuay, buyers and sellers.

Important marketplace status

CardQuay is in a private Australian beta. Members can list, message, make offers, trade cards and record Direct Deals. Safeguarded Trade is shown as an in-development service but cannot currently be selected or paid for. Historical Stripe Sandbox records may be retained for testing and audit; Stripe is not used to pay sellers.

1. Who operates CardQuay

CardQuay is a registered Australian business name held and operated in New South Wales by WANG, LIYUAN, an individual sole trader (ABN 66 120 438 006). In these Terms, “CardQuay”, “we”, “us” and “our” refer to that operator.

2. Acceptance and eligibility

By creating an account or using CardQuay, you agree to these Terms and the policies linked from our Compliance Centre. You must be at least 18 years old, able to enter a binding agreement and located in Australia. CardQuay's initial launch is limited to Australian users and Australian delivery addresses.

3. One account for buying, selling and trading

CardQuay does not separate collectors and sellers into different user types. An account may buy, list or trade cards after required identity and contact checks. You must provide accurate information, protect your password and promptly tell us about unauthorised access. You may not transfer, share, sell or create an account for another person.

4. Selling and trade access

CardQuay may require email, phone, identity, address or ownership verification before granting or continuing selling and trade access. Requirements may vary according to transaction history and risk. Approval may be reviewed, restricted or withdrawn to protect members or comply with law.

5. Listings

You may only list cards you own and are legally entitled to sell or trade. Images must show the actual card unless clearly identified otherwise. Titles, prices, certification details, alterations, defects and condition notes must be accurate. You must keep at least one receiving method and the offered postage options current, and promptly update or remove a listing that is no longer available.

CardQuay may review, edit the presentation of, hide or remove a listing. Approval or publication does not amount to authentication, appraisal, endorsement or a guarantee of value.

6. Direct Deals

The contract for a card is between the buyer and the identified seller. For a Direct Deal, CardQuay records confirmations and privately displays the seller's selected receiving details after the seller confirms availability. The buyer pays the seller directly, and the seller checks their own account before dispatch. CardQuay does not receive, hold, verify or reverse the card payment and does not guarantee either member's performance.

Private and business sellers have different obligations under Australian law. Sellers must accurately identify whether they act in trade or commerce. Nothing in these Terms excludes rights that cannot lawfully be excluded.

7. CardQuay Safeguarded Trade

Safeguarded Trade is not currently available. Its planned workflow and proposed prices may be displayed for transparency, but those displays are not an active offer to provide the service and no new Safeguarded checkout is enabled. If the service launches, CardQuay will publish binding scope, cancellation, custody, forwarding and optional insurance terms before payment. CardQuay does not plan to authenticate or guarantee authenticity, and the card price would remain payable directly to the seller. See the Safeguarded Trade Service page.

8. Trades and cash differences

A proposal may include multiple cards and an optional cash difference. A trade is not final until both users accept the same terms and complete the required confirmations. Direct Trade is the currently available fulfilment method: participants send cards and pay any cash difference directly to each other. A Safeguarded fulfilment option is planned but disabled.

9. Prices, services and taxes

Prices are shown in AUD unless clearly stated otherwise. CardQuay does not take a percentage of Direct Deal card payments. Postage, insurance and any cash difference are agreed directly between members. CardQuay does not currently collect a transaction or Safeguarded service payment for a new transaction. Sellers remain responsible for their own tax, registration and reporting obligations.

10. Acceptable use

You must not use CardQuay to mislead, harass, impersonate, manipulate prices or feedback, attempt to bypass disabled or restricted workflows, scrape the service, interfere with security, distribute malicious code, launder money or conduct an unlawful transaction. The Prohibited Items Policy forms part of these Terms.

11. Suspension and termination

We may restrict a listing, trade, feature or account where reasonably necessary to protect users, investigate a report, comply with law or enforce these Terms. Where appropriate, we will explain the action and provide a way to contact us. You may request account closure, subject to unresolved transactions, disputes and lawful record-keeping requirements.

12. Intellectual property

You retain ownership of content you submit. You grant CardQuay a non-exclusive, worldwide, royalty-free licence to host, reproduce, resize and display that content for operating and promoting the marketplace while the relevant listing or account is active, and for reasonable archival, safety and legal purposes afterwards. You must have the rights needed to grant this licence.

13. Service availability and liability

We work to keep CardQuay reliable and secure, but do not promise uninterrupted availability or that every user, listing, card, grade or valuation is accurate. To the extent permitted by law, CardQuay is not responsible for indirect or consequential loss, market price movements or member-to-member payment arrangements. Any liability that cannot be excluded is limited only to the extent permitted by the Australian Consumer Law.

14. Changes and governing law

We may update these Terms to reflect legal, safety or product changes. Material changes will be notified through the service or by email before they take effect where reasonably practicable. These Terms are governed by the laws of New South Wales, Australia, and the courts with jurisdiction there.
