SELLER AGREEMENT
List honestly. Confirm carefully. Fulfil promptly.
These additional terms apply whenever a member lists, sells or offers a card in trade on CardQuay.
1. Relationship to the Terms
This Seller Agreement forms part of the Terms of Use. If there is an inconsistency, this Agreement applies to selling and trade activity. “Seller” includes a user offering a card for money, trade or a card-and-cash exchange.
2. Eligibility and verification
You must be at least 18, reside in Australia and provide accurate identity, email, phone, address and—where applicable—business and tax information. CardQuay may require identity verification, proof of ownership or enhanced checks and may review access according to transaction and safety history.
3. Seller status
You must accurately tell us whether you sell privately or in trade or commerce and update that status if circumstances change. Business sellers must provide required registration details and comply with the Australian Consumer Law. CardQuay may correct or restrict a status that appears inaccurate.
4. Ownership, authenticity and images
You promise that you own every listed card, have the right to transfer it and that it is not counterfeit, stolen, subject to an undisclosed security interest or otherwise prohibited. Images must be your own or lawfully used and must show the actual card. Stock images are not permitted unless CardQuay specifically authorises them and the listing makes this clear.
5. Accurate description
Disclose visible and known defects, alterations, restoration, trimming, recolouring, surface damage, print lines, creases, dents and case damage. Any certification information you provide must be accurate and must not be reused for another card. CardQuay may request front, back, edge, serial-number or timestamped images.
6. Price, receiving details and availability
Prices must be genuine and in AUD. Keep your PayID or bank receiving details accurate, disclose each postage option and price before commitment, and discuss any optional insurance with the buyer. Do not request an undisclosed amount, create fake sales or arrange misleading activity. Remove or update cards that are sold, reserved or unavailable.
7. Direct Deal confirmation
When a buyer requests a Direct Deal, the card is marked Sold Pending. You must reconfirm that the card is available, select the correct receiving method and confirm the offered postage option before the buyer is asked to pay. Check cleared funds in your own account before confirming receipt. A screenshot or buyer declaration alone is not proof of payment.
8. Dispatch and evidence
After confirming payment, use the buyer address shown inside the transaction and dispatch within three business days unless a different handling time was accepted. Follow the Shipping Policy, enter accurate carrier and tracking information, and upload the requested lodgement or postage evidence. Do not reveal the buyer's address outside fulfilment.
9. Safeguarded Trade
Safeguarded Trade is in development and cannot currently be selected for a new sale or trade. Do not send any card to CardQuay unless an authorised CardQuay operator gives instructions for an existing recorded beta matter. The planned workflow and proposed service prices do not create a current custody or fulfilment service.
10. Returns, refunds and disputes
You must respond to cancellation, return and dispute requests in good faith, preserve evidence and provide remedies required by law or your stated policy. Direct Deal refunds are arranged directly with the buyer because CardQuay did not receive the card payment. CardQuay may record outcomes, restrict accounts or coordinate cards in its possession, but cannot reverse an external bank transfer.
11. Trades
Only offer cards you own and can dispatch. Do not substitute cards after acceptance. Record each card, cash difference and postage arrangement in the confirmed proposal. Direct Trade is the available fulfilment method. You are responsible for packaging, tracking and promptly reporting a failed or unsafe trade.
12. Taxes and records
CardQuay does not deduct a percentage charge from your Direct Deal receipts and does not currently collect a Safeguarded service payment for a new transaction. You are responsible for determining GST, income-tax, business-registration, record-keeping and reporting obligations.
13. Monitoring and ending access
CardQuay may review listings and transaction patterns, request evidence, delay publication, hold or remove listings, restrict seller access or suspend an account where reasonably necessary. You may stop listing after completing open commitments. Obligations relating to completed transactions, refunds, disputes and records survive account restrictions or closure.
